The primary aim of this course is to help you think like a lawyer. The structure of the class is a traditional first year law school class that uses the Socratic method. The format for discussing cases will be NIRACPDS.
This class will emphasize 3 different skills. First, class participation. You must be prepared to discuss the assigned material each day in class. Second, brief writing. You may turn in at the beginning of class your written brief, 1 page, of one of the cases assigned. I will ask you to brief cases according to the simple IRAC format. Each satisfactory brief will count 1 point toward your final examination score
Third, examination writing. At the mid-term there will be a take home examination in the law school style. I will provide you with a fact pattern and you will identify and analyze the elements of all the relevant claims and defenses contained in the fact pattern. This examination will determine 30 points of your grade. During finals week you will take an expanded version of the mid-term in class. The final will determine 70 points of your grade.
If some or all of you wish, during the last weeks of the class I will help you prepare a brief and oral argument to a court. You may earn up to 20 points toward the final for this work.
The text for the class will be Cases and Materials on Employment Discrimination by Michael Zimmer, et al. I have ordered the book through the Book Stop.
