Who may contest a ticket?
Any person desiring to contest a ticket may request a hearing.
How is a ticket contested?
The petitioner needs to come to Parking Services in Gray Hall and fill out a hearing request form to be submitted to the Parking Service Office within ten(10) calendar days after the date the citation was issued. The hearing request form includes a written statement of the circumstances surrounding the citation.
What if it is 10 days past the issuance of the citation?
Anyone who fails to request a hearing within the prescribed time waives his right to a hearing and subjects himself to the monetary fine and penalties.
What should be included in the written statement?
The statement should include clear and convincing evidence. It should clearly state all the facts and deal with both sides of the issue. The statement may include an explanation of circumstances that were life threatening or situations that were beyond the petitioner's control.
How does the petitioner prepare for a hearing? What evidence should be presented?
The petitioner should review the circumstances surrounding the citation and inform the hearing officer of any additional details which weren't included in the written statement. The defense should present the facts to the hearing officer in a clear, concise and orderly manner. The petitioner may bring witnesses and/or photographs to the hearing.
When and where are hearings held?
The hearings are held in the Parking Service Office in Gray Hall usually once a week.
Who will be present at the hearings?
The petitioner, the hearing officer and any witnesses shall be present. The Parking Service Office may have a member present to serve in a representative capacity.
What if the petitioner cannot attend a hearing in person?
If the petitioner cannot attend a hearing in person or does not wish to appear in person, his case will be heard on the basis of his written statement only. The hearing officer's decision is final. If a petitioner does not appear in person and is dissatisfied with the hearing results, a second hearing on the offense will not be granted.
What happens if the petitioner misses a scheduled hearing appointment?
If the petitioner knows that he will not be able to appear at the time scheduled he may call to either reschedule the appointment or request that the hearing be heard on his written statement alone. If the petitioner fails to appear without prior notice to the Parking Service Office, his petition will be judged on the basis of his written statement. If a petitioner does not appear in person and is dissatisfied with the hearing results, a second hearing on the offense will not be granted.
Who is the hearing officer?
The hearing officer is a fair and impartial arbitrator, hired by Parking Services. He may be a member of the University community or the community at large. THE HEARING OFFICER'S DECISION IS FINAL.
What happens when a ticket is dismissed by the hearing officer?
If the hearing officer dismisses the ticket it is canceled at no cost to the petitioner.
What happens when a ticket decision is upheld by the hearing officer?
If the hearing officer upholds the ticket decision, the fine must be paid. The petitioner will be notified by mail of the hearing officer's decision. In addition to the original fine amount the petitioner will be assessed a $10.00 court cost on each ticket that is upheld. All fines and court costs must be paid to the Parking Service Office within (10) calendar days of the disposition notice.
What happens if the payment of the upheld citation is not made within 10 days?
Any fines due and unpaid after (10) calendar days from the date of the disposition notice will be increased by a $10.00 per parking notice billing fee. Students will be billed by the accounting office for delinquent fines, court costs and billing fees. Faculty/Staff members will be billed for delinquent fines, court costs and billing fees by the Parking Services Department and can expect to have any unpaid amounts withheld from their paychecks. Unpaid parking charges, court costs and billing fees incurred by others will be turned over to the State Collection Agency following normal Parking Services billing procedures.
What is the purpose of the court cost?
The court cost is used to offset the cost of processing a hearing and the cost of engaging a hearing officer.
K-lot Permits FAQs
What are K-lot permits?
K-lot permits refer to the small lot near Carter Hall (Bldg 10 on the Parking Map) and Kepner Hall (Bldg 2), located in Central Campus, near 17th Street and 8th Avenue. The primary candidates for purchase of the Student K-lot permits are junior and senior Business majors, PVA majors or Music majors. The Student K-lot permit allows access to the east side of the lot and to all other student lots on campus. Freshmen, sophomores and upperclass students who are not Business majors, PVA majors or Music majors can likely make good use of the standard student permit, available for a lower price. The standard student permit allows parking in all student lots on campus except for the K-east lot.
